Privacy Policy pursuant to Art. 13 of Legislative Decree No. 196 of June 30, 2003 on the protection of personal data and Art. 13 of EU Regulation 679/2016 – General Data Protection Regulation (“GDPR”)

Pursuant to the provisions of the aforementioned regulations, our Mediation Agency hereby wishes to inform you in advance about both the use of your personal data and your rights, communicating the following:

1. DATA CONTROLLER AND DATA PROTECTION OFFICER

The Data Controller is IGOR DAPUNT BROKERAGE SAS, with registered office in Bolzano, Via Leonardo da Vinci 16. The updated list of data processors, together with their respective areas of responsibility, is available at our office.

2. PERSONAL DATA SUBJECT TO PROCESSING

For the purpose of carrying out real estate brokerage activities and to meet your service request, we use certain personal data of the data subject. These include identification data, contact details (address, landline, mobile phone, fax, e-mail), data relating to the property, financial capacity, land registry certificates and property provenance, and information regarding family composition.

3. PURPOSES, LEGAL BASIS AND MANDATORY OR OPTIONAL NATURE OF PROCESSING

Such data will be provided by the data subject and collected by our staff and collaborators, also by electronic or telematic means, in order to carry out real estate brokerage, to execute a service or contractually agreed operation, to verify the progress of contractual relations as well as the risks connected to them. The provision of such data is mandatory, otherwise we would not be able to fulfill, in whole or in part, the above-mentioned mandate, and your data may also be collected from third parties. Some information may have to be communicated by you or third parties in order to comply with legal obligations (e.g. anti-money laundering regulations). Your identification data will also be processed to comply with obligations provided for by state laws, regulations and EU legislation, or by provisions issued by authorities empowered by law and supervisory bodies. Such processing does not require the consent of the data subject. Your e-mail address may be used by the Data Controller to send you commercial communications regarding products and services similar to those provided, pursuant to Art. 130, para. 4, Legislative Decree 196/2003. You may object to this processing at any time. Such objection will have no effect on the pursuit of the main purpose of carrying out real estate brokerage activities.

4. RECIPIENTS

Your data will be made known to our internal administrative staff and external collaborators, whose list is available at our office, and will also be disclosed to our service providers such as IT companies, outsourcing companies, consultants and professionals, insurance companies, debt collection companies, fraud control companies, institutions and/or associations, companies or entities appointed by us as data processors, whose list is available at our office. Furthermore, your data may be communicated to technicians for property checks at the Land Registry and/or other institutions, entities or registers.

5. TRANSFERS

Some of your personal data may be transferred to recipients located outside the European Economic Area. The Data Controller ensures that both electronic and paper processing of your personal data by such recipients complies with applicable law. Transfers are based either on adequacy decisions or on the Standard Contractual Clauses approved by the European Commission. 6. DATA RETENTION

All personal data provided will be processed in compliance with the principles of lawfulness, fairness, relevance and proportionality, using only the methods, including IT and telematic, strictly necessary to achieve the purposes described above. In any case, personal data will be retained for no longer than is strictly necessary for the achievement of those purposes. Personal data that is not required to be retained for the stated purposes will be deleted or transformed into anonymous form. It should be noted that the information systems used to manage the collected data are configured from the outset to minimize data use.

7. YOUR RIGHTS

As the data subject, you have the rights set out in Art. 7 of the Privacy Code and Art. 15 GDPR, specifically the rights to:

  1. obtain confirmation as to whether or not personal data concerning you exists, even if not yet recorded, and communication of such data in an intelligible form;
  2. obtain information on: a) the origin of the personal data; b) the purposes and methods of processing; c) the logic applied in case of processing carried out with electronic means; d) the identification details of the controller, processors and representative designated pursuant to Art. 5, para. 2 Privacy Code and Art. 3, para. 1 GDPR; e) the subjects or categories of subjects to whom personal data may be communicated or who may become aware of it as designated representatives in the State territory, as processors or persons in charge;
  3. obtain: a) the updating, rectification or, where interested, integration of the data; b) the erasure, anonymization or blocking of data processed in violation of the law, including data whose retention is unnecessary for the purposes for which it was collected or subsequently processed; c) certification that the operations referred to in letters a) and b) have been notified, including their content, to those to whom the data were communicated or disclosed, except where such compliance proves impossible or involves a manifestly disproportionate effort compared with the protected right;
  4. object, in whole or in part: a) for legitimate reasons, to the processing of personal data concerning you, even if relevant to the purpose of collection; b) to the processing of personal data concerning you for the purpose of sending advertising materials, direct sales, market research or commercial communication, using automated calling systems without human intervention, by e-mail and/or traditional marketing methods by telephone and/or postal mail.

Where applicable, you also have the rights under Articles 16–21 GDPR (right to rectification, right to erasure, right to restriction of processing, right to data portability, right to object), as well as the right to lodge a complaint with the Supervisory Authority.
